Filming without Consent

Expat Youtubers are filming everything they see and do.

Little do they realize, that citizens are protected by law against getting filmed against their wishes.

Section 397, quoting directly: “Whoever in a public place or before the public, does by any means whatever to annoy or intimidate another person or causes the other person to be ashamed or troubled, shall be punished with imprisonment not exceeding one month or fined not exceeding 5,000 baht or both.” 

All a person has to do is make a complaint to the police and the leeway is all in their favor.

As you can see in the photo, this girl appears to be quite annoyed a Youtuber is filming her on the beach.

Rightly so, she could contact the police and file a charge.

Personal Data Protection Act, B.E. 2562, section 19 paragraph 1: “The data controller shall not collect, use or disclose personal data unless the data subject (that is the person whose data is being taken, has given consent prior to or at the time of such collection.

Youtuber’s are hell bent to make money in order to stay in Thailand.

Me personally, I don’t want to be on Youtube or I would do it myself.

Some of these Youtubers at the beaches border on being perverts and I am sure some women do not want to be exposed that way.

Under the new law, people can post video clips of themselves with others for PERSONAL purposes online, WITHOUT THE INTENTION OF COMMERCIAL GAIN OR CAUSING DAMAGE.

Any person can claim damages if they are filmed for Youtube without their consent.
